Fidic dispute adjudication: outline and core elements

Abstract: There is a trend to resort to dispute boards in major construction agreements, especially those executed under the rules of the FIDIC. In this context, the author examines the FIDIC's Red Book, which deals with the Dispute Adjudication Boards, chosen by the parties and constituted since the execution of the agreement, whose task is to follow the execution of the works, rendering recommendations, opinions and decisions whenever the parties deem them necessary, and becoming often a prior phase to arbitration.
